Ray Tartaglione is at it again. The Hen Island resident and agitator, creator of Mr. Floatie the 8-foot turd and the money behind Heal The Harbor, filed a lawsuit on Monday to compel the City of Rye to enforce its sewage laws as per code 161-1
entitled "Use of Public Sewers." In April a state court tossed another suit brought by Tartaglione against Kuder Island Colony, the owners of Hen Island.
Will Rye Mayor Doug French now have the odoriferous task of dealing with Mr. Floatie at various council meetings? Or will French and the council be able to flush Floatie once and for all?
Just last November Tartaglione promised he'd flush Mr. Floatie for good. Looks like his promise got "backed-up".
In a PR release, Tartaglione said "During a recent Rye City council meeting of April 21th 2010 Mayor French
stated "sewage issues are the responsibility of the County Health
Department", he refused to take a position on the illegal septic systems
and refused to enforce current city code 161-1. He additionally stated
"this code is not relevant", "the sewage issue does not pertain to this
council", "this council is only interested in taking action on matters
that it can effect" He also threatened to change the law rather than
enforce it and submit the findings of the inspections to the County
Health Department."

This lawsuit would impact the rest of Rye more than Hen Island. Rye residences with septic systems should monitor this suit closely. Hen Island houses are seasonal which 161-1 doesn’t address. How someone who isn’t a resident of Rye and pays no taxes to the city of Rye is able to sue the city of Rye boggles the mind.
Septic –
Don’t be surprised that a non-resident who pays no taxes can sue the city. On any given day we have hundreds, perhaps thousands or even tens of thousands (factoring in highway and rail passengers) of people travelling through the city. They have a right to bring a suit against the city for any grievance they have, real or imagined, for activities that happen while they’re in Rye.

The question you should be asking is “why doesn’t the City of Rye enforce their laws so we don’t get sued”?
It’s amazing how many of you forget why these law suits are brought forward to begin with!
We were lucky Mr.Amico didn’t bring forward a lawsuit after the RPD blatantly VIOLATED his rights back in January!

FYI. The taxes paid to the City of Rye from Hen Island yearly turn out to be over 135,000.00. For that; we do not burden the school system with our children; we do not receive any municipal services with the exception of the use of one garbage truck for three hours once a year. We need no street cleaning. We have no storm or sanitary sewer service required. No snow removal. We even pay the non-resident fees at the marina to store our boats. If you should base the taxes on the square footage of our homes we probably pay twice the rate as any resident in Rye and we are only there for three seasons. Now here is the best; It took the building department three years to find and issues three pages of violations to a community that has never been required to meet code and when I ask the city to stop the same community from polluting the long Island Sound with their sewage, remove a mosquito infestation second to none and require them to meet the same potable water requirements as any other resident in Rye, the City that receives the $135.000.00 tells me it is not their problem. To me it appears to be taxation without supplying the services we pay for. Sorry we have to do this dance once again Matt but I am just trying to keep my back yard as safe and healthy as yours.

I was merely pointing out to Septic Shock that a lawsuit may be brought against the city by anyone – there is no pre-requisite that the plaintiff must be a resident or pay taxes in order to sue.

The city asked the BOH to go out and inspect the septic systems on Hen Island last year. The city responded to Mr. Tartaglione’s complaint and a verdict was issued after numerous inspections over the course of last year. They concluded the systems were adequate. Mr.Tartaglione doesn’t like that answer. The city did exactly what Mr. Tartaglione wants except the BOH’s answer wasn’t the one Mr. Tartaglione was looking for.
Mr. Tartaglione left out the fact that Hen Island gets excellent police and fire protection 7 months a year and also the fact that we get more than one garbage pick up a year.
Will Healtheharbor be the first environmental group to ever endorse drilling in an ecologically fragile wetland? Will they be the first environmental group to endorse dredging a sewer pipe across sensitive and ecologically important wetlands and watercourses? What do other environmental groups think about drilling or dredging in sensitive wetlands which are, for all intents and purposes, an extension of the Rye Conservatory? Will Healtheharbor be the first environmental watchdog group to endorse mosquito spraying in wetlands abutting the Long Island Sound? Has Toto finally slipped under the curtain and revealed Healtheharbor as a sham????????????????????????

Answer; first of all we are not drilling for oil, only water. It was only a few years ago when Hen Island was still burying their garbage in the “ecologically fragile wetland” and now you are worried about drilling for water? No don’t drill for water, let your kids keep brushing their teeth and taking showers in bird feces infected water, that’s the Hen Island way.

Answer; No, we should allow the sewage to continue to enter the beaches of Greenhaven and Milton Harbor. Was that the City of Rye that just last year dredged almost a mile of Milton Harbor? It is surely environmentally safer to pollute the water rather than lay a pipe 450 feet long, no dredging necessary. Just install a sign along the beach on Hen Island that states, “If you drop anchor here and break the pipe, the sewage from Hen Island will be polluting Milton Harbor as it used to”. Or you could just test all the systems on the Island and require the ones that fail to install composting units or self contained units that have to be pumped out periodically.
Question; What do other environmental groups think about drilling or dredging in sensitive wetlands which are, for all intents and purposes, an extension of the Rye Conservatory?
Answer; I am sure the Marshlands Conservatory, The Rye Nature Center, The Greenhaven Homeowners Association, American Yacht Club and Shenorock Shore Club is happy that Hen Island sewage is entering the waters their members swim in. And they would surely let their children use that water to brush their teeth and bathe. Leave everything the way it is, that is the best way to protect the environment and the people.
