Jovanovich To Run For Rye Mayor

Rye City Councilman Peter Jovanovich will run as an independent for Rye City mayor this fall, challenging Rye City Councilman Joe Sack.

Jovanovich Declares Candidacy for Mayor of Rye

Councilman and Deputy Mayor Peter Jovanovich announced today that he is running for Mayor as an Independent. Through the petition process, he plans to be on the ballot this fall.

“I believe that the City of Rye can only be made a better place through the collaboration of Democrats, Republicans, and Independents,” explains Jovanovich. “The challenges we face are practical, not partisan; and we need volunteers from all points of the political spectrum.”

Here are some of the issues that he has addressed in his first term on the Council and will focus on as Mayor:

1. Infrastructure

Rye made a good step forward by approving the infrastructure bond last fall. But there is more work to be done: rebuilding the road bed and walkways at Station Plaza, improving traffic and pedestrian signals at Theodore Fremd/Purdy Avenue intersection, and upgrading crosswalks and sidewalks, particularly near schools.

2. Labor Negotiations

With the total compensation of City employees rising 7-8% a year, the City needs a new deal with its unions. In particular, the City must slow the rise in health care costs. The City Manager has advocated, in numerous negotiating sessions with our unions, to reform our labor agreements. “The Council must continue to support the City Manager in his negotiations with our unions,” says Jovanovich.

3. Environment

Working with members of the Sustainability Committee, Councilman Jovanovich enthusiastically supported the plastic bag ordinance. He further supports the Sustainability Committee’s agenda to preserve open space in Rye.

He pledges to protect our land use commissions from political influence. The Mayor and Jovanovich were pressured by the chairman of a Rye political party to fire the Chairman of the Planning Commission, and to appoint a “developer-friendly” replacement. They refused. Jovanovich states: “I promise to only appoint members to the land use commissions and boards who believe they are stewards of Rye’s neighborhoods, wetlands, and wetland buffers.”

4. Financial Sustainability

The City is now in excellent financial health because of the difficult decisions made over the last four years to deal with the worst recession in 75 years. Services were maintained while taxes stayed under the tax cap, expenses held flat, reserves restored, and our AAA rating reaffirmed.

5. The Rye Free Reading Room

The Recession put pressure on all City Departments and its non-profit partners like the Library. As Council liaison to the Library, Jovanovich worked closely with the Board of the Rye Free Reading Room to negotiate a sustainable labor agreement. He strongly promoted the use of bond funds to provide sprinklers and other improvements to the library’s historic building.

6. Golf Club

The Golf Club scandal revealed several shortcomings in the way the City of Rye conducts its business – particularly at the Enterprise Funds (Boat Basin and Golf Club.). First, the City needs stronger auditing oversight. Jovanovich proposes the City hire a full-time internal auditor, and, to supplement and provide further oversight, also contract with specialist outside auditors to review the Golf Club and the Boat Basin — places where a great deal of monetary transactions take place.

Second, to provide proper checks and balances in the operation of Enterprise Funds, Jovanovich supports new governance procedures, including the expansion of the Golf Club and Boat Basin Commissions to include citizens with financial expertise.

Third, reinforce the mission of providing low-cost recreation amenities. “We have lost sight of this goal: to provide affordable access to recreation,” says Jovanovich. “The cost of a pool membership at the Golf Club is now three times the average cost of other pools in Westchester. That’s not right.”

7. Playland

Councilman Jovanovich has strongly supported Sustainable Playland Inc.’s proposal, from its inception, to save the Park. If elected Mayor, he will work tirelessly to see this innovative approach to recreation in a parkland setting come to fruition.

Jovanovich says he will pursue a balanced approach to governing, combining sound fiscal management with improvements to Rye’s infrastructure and enhancements to its quality of life.

“That’s been my approach throughout my life in Rye,” he states. “Whether as a Director and Treasurer of the Friends of the Rye Nature Center, Council Liaison to the Rye Free Reading Room, or as a member of the Board of Architectural Review and the Planning Commission, I have concentrated on serving the best interests of Rye ¬without regard to political affiliation. If elected Mayor, I will continue in that manner.”

Peter Jovanovich has enjoyed a varied career in book publishing, philanthropy, and public service.

Publishing

A graduate of Princeton University, he started in publishing as a college sales representative for Macmillan in 1972. He held various editorial and marketing positions in Macmillan’s College and Trade Divisions until 1977, when he was named a vice president of Macmillan Publishing and head of its trade division.

Mr. Jovanovich joined Harcourt Brace Jovanovich, Inc. in 1980 and held a series of positions, including President of HBJ’s Trade Division, Managing Director of HBJ, Ltd. (London), and President of Academic Press.  In 1989, he was named President and CEO of HBJ.

In 1992, Mr. Jovanovich was recruited to become CEO of Macmillan/McGraw-Hill School Publishing. In 1995, he became President of McGraw-Hill’s Educational and Professional Group. During his tenure, McGraw-Hill became the largest educational publisher in the world.

In 1997, Mr. Jovanovich joined Pearson, plc where he oversaw the creation of Pearson Education, which eventually surpassed McGraw-Hill to become the world’s largest education company with over $4 billion in sales and 20,000 employees. Mr. Jovanovich held the position of Chairman and CEO of Pearson Education until 2005, when, because of health reasons, he went on long-term leave.

Jovanovich also served as a director and Chairman of the Board of the Association of American Publishers. He was elected to the Educational Publishers Hall of Fame in 2007.

Philanthropy

For the past six years, Peter Jovanovich has served pro bono as president of the Alfred Harcourt Foundation, based in Rye. The Foundation provides college scholarships to low-income students from some of the lowest-performing high schools in the metropolitan area. Currently, the Foundation gives approximately $650,000 a year in scholarships supporting approximately 110 students, most of whom attend the City University of New York.

Uniquely, the Harcourt Foundation seeks students whose test scores are not stellar, but who have exhibited the personal strength to overcome significant life challenges. Through the provision of tutors and mentors, and the personal intervention of Mr. Jovanovich, who interviews each one of the students each year, approximately 75% of the Harcourt scholars graduate in four years. (The national average for low-income students is closer to 30%.)

Public Service in Rye

Peter Jovanovich was elected City Councilman in 2009, and for the last two years has served as Deputy Mayor. He has helped Rye restore its financial health, improve and invest in its infrastructure, and enhance our quality of life.

Mr. Jovanovich joined the Board of the Friends of Rye Nature Center in 2007, eventually serving as Treasurer. During the difficult times of the last recession, he worked with the Director and other Board members to make the difficult decisions necessary to save the “Friends” organization. Today, the Friends of Rye Nature Center is thriving: more programs are being provided to more children than ever before. 

He served Rye as a member of the Board of Architectural Review and the Rye Planning Commission. As Council liaison to the Rye Library, Jovanovich worked closely with the Board to negotiate a sustainable labor agreement. He strongly promoted the use of bond funds to provide sprinklers and other improvements to the library’s historic building.

His wife Robin, publisher of The Rye Record, has served as a director of the Rye Arts Center, and Vice-President of the Rye Free Reading Room. She is currently a member of the Board of Architectural Review. Her engagement in helping the non-profits around town is known throughout the community.

Robin and Peter have two grown sons, one a graduate of Rye High, and the other a graduate of Rye Country Day School. Both are married and living in Brooklyn.

    When I first saw the picture of this jackass I figured it was because he got arrested for all the corruption that has been going on in Rye since he became a councilman.

    This apparent delusional individual actually thinks he is running for Mayor. Alfano, Ted Dunn, Matthews, French, Filippi, Suzanna Keith, Matt Fahey and his sister Robin adds up to 9 signatures on a petition assuming he signs his own petition This leaves him about 500 signatures short of getting on the ballot.

    Now that Jovanovich was rejected by his own Republican party, and no doubt laughed at when he tried to get on the Democrat ticket, he now cites collaboration and non-bitarisanship. How convenient.

    Hit the bricks you pompous jackass and save us from having to look at your face and from throwing up reading your bogus accomplishments.

  2. Interesting bio, but I have never been one to buy into the “Princeton” bullshit. They don’t have a top 5 MBA program or a top 3 law school, therefore there are limited choices for undergrades to get exposure from the best Professors the country has to offer – frankly the degree is irrelevant except if you want to pimp yourself as God’s gift to international studies – bullshit in and of it self. Ok, let’s focus and get off the Princeton bashing. 1. OK, choice is good; 2. running against the Republican candidate to vet policy differences where Sack snatched the RGC investigation out of the hands of his fellow “Republicans” and handed it to a pipe hitting, all bitch Battery Park law firm (quickly do the math because I know Old Garnet will be – 1400 members and an average family of 4, and your frauding roughly 1/3 of the population) and where he narrowly escaped involving City government in a felony fraud for the police uniform bidding, and what other major policy differences is he going to hang his hat on; 3. draw away support from Rye Republicans and receive registered Democrats, seriously? He’s running independently rather than primarying Sack because he doesn’t want to get knocked out of the box in September but continue his poorly disguised facade until November. Bottomline, at this point in time August 2013, Sack literally walks on water in this town – he’s unbeatable. Fast forward to election results this November: Joseph A. Sack, Esq. 90.9%, Peter Jovanovich 9.1%, if that. Remember you saw it here first, folks…;)…and, most importantly, who is vetting his 377 signatures, and can he be trusted considering his performance since, what 2009?

When your time allows, I am wondering what your view is of the ADA handling the issue who has an alleged personal relationship with the City Manager, the same City Manager who allegedly approved $7 million in invoices over a number of years.   8. On October 10, 2012, the City Council voted 6-0 to take over the investigation into Rye Golf Club. Councilman Peter Jovanovich was absent from the meeting and therefore did not participate in the vote. Councilman Jovanovich also missed five additional meetings before the year-end including some special sessions where important decisions were made regarding the investigation. Prior to the investigation, when Golf Club members began questioning the excessive overtime hours and costly invoices (information obtained through FOIL), Councilman Jovanovich called the Rye Golf Club matter and/or Councilman Sack’s effort to obtain information from the City Manager on the part of club members, “a faux cause célèbres”, the “the latest mini-drama”, and “another Rye City Council sideshow”.

    “The latest mini-drama” actually turned out to be the largest theft in City of Rye history. It has been said that the city’s investigation report reads like a crime novel, and golf club members were shocked to learn of failure after failure to spot the level of fraud which took place over a six year period. City Manager Pickup signed off on $4 million dollars worth of the invoices- it remains unclear exactly how many hundreds of thousands of dollars paid out to the staffing company were fraudulent, and how much was syphoned out the other end to the ex-Golf Club Manager.

    Unfortunately in our city, right now, there is no accountability because of people like Peter Jovanovich. In 2010, Mr. Jovanovich sat on the City of Rye Audit Committee and was not only issued a written report which spotted bidding deficiencies and cash flow problems at Rye Golf Club, but he sat in Council Chambers and listened to a televised summary. Not once has Mr. Jovanovich been made to answer for his “mini-drama” comments and ridicule before the investigation even began. We never heard a public apology, or admission once the findings were made public. Further, Mr. Jovanovich has refused to address numerous problems with City Management- an issue he politicized in his 2009 campaign.

    Last fall, we learned the value of Open Government and transparency through FOIL, for without the efforts of club members, Commissioners, residents, and Councilman Sack asking for information, an investigation into Rye Golf Club might never had happened. It took months and months for Mr. Sculti, a golf club member, to obtain the information he requested through FOIL, and even now, in Council discussions regarding the city FOIL policy, Mr. Jovanovich has supported keeping the old system (in which the City Attorney and City Management have total control over what documents are released) and moving to a new system in which the honest people on our City Council- the people we elect to represent us- have no involvement.

    Councilman Jovanovich continues to support a City Manager who lied to club members at a September Commission Meeting- something that was documented in the Brune and Richard report earlier this year. In the past year and a half, City Manager Pickup has displayed numerous other examples of dishonesty and complete incompetence, yet none of them move Mr. Jovanovich in the least.

    A former CTB/McGraw-Hill executive in Monterey who was fired from her $125,000 a year job was awarded $450,000 by a federal court jury for wrongful termination.
    The jury of three men and five women in federal district court in San Jose also ruled the former Macmillian/McGraw Hill School Publishing Co. acted in bad faith when Judith Ann Hill, 41, was fired on June 10, 1993, from her position as vice president of finance.
    In her lawsuit, Hill said that Peter Jovanovich, president and chief executive officer of what is now McGraw Hill School Publishing Co., owned by The McGraw-Hill Companies, flew to Monterey from corporate headquarters in New York to personally fire her after she complained of being sexually harassed by him.
    Jovanovich told Hill at one point that “he wanted her to be his moll,” said Novato attorney Nancy Krop, who represented Hill.
    When Hill protested, “basically” that was the end of her career” with the company, Krop said.
    Hill had also accused the company of sex discrimination and Jovanovich with sexual harassment in her lawsuit, but the jury ruled against her on those points, said company spokesman Steve Weiss.
    The $450,000 judgment against the company, which later in 1993 became The McGraw-Hill Companies, was the maximum award allowed, Krop said.
    “I think the company had to learn you treat people more humanely,” Krop said yesterday.
    Weiss said the jury award was likely the result of the company’s failure to give Hill written warning that her job was in jeopardy before firing her.
    Even so, “We do believe that we have a very valid basis for appealing the jury’s decision,” Weiss said. He added that the company hasn’t decided whether to appeal.
    Hill, the mother of two college-aged daughters, began her career as a $17,500 senior accountant and rose in 11 years to become the chief financial officer of the company’s CTB division in Monterey, earning $125,000 a year, Krop said.

  13. I don’t mean to disappoint anyone, but I doubt there is any validity to the complaint about Julie Killian’s involvement with New Yorkers for Growth. It’s a legitimate PAC which backs fiscal conservatives but, as far as I know, they don’t lobby.

    Regardless, this is a thread about Peter Jovanovich so let’s post about Julie elsewhere.

    Regarding Peter, his quixotic run for mayor reminds me of Vito Lopez running for NYC Council, the primary difference being, Lopez could win. Learning about his history in the private sector, I find Peter’s hostility toward Andrew Dapolite (as a whistleblower) understandable, but still unforgivable.

    Quite honestly everyone on the council now has nothing to be proud of regarding Andrew. You all know he was telling the truth. If you were stand up people, he’d get his job back with back pay and an apology. Some of you of course are more craven than others but you all should be ashamed of your behavior regarding Andrew.

    Peter was especially nasty though. He has to live with that. He should not under any circumstances be rewarded with a term as mayor of Rye.

  15. A. Dapolite efficiently outlines Jovanovich’s failures and character flaws, making a strong case for why he would be a dreadful mayor. An important point to note about Jovanovich’s refusal to hold Pickup accountable for the RGC fleecing is his apparent lack of understanding of the word SCOPE in an audit. I’d guesstimate Jovanovich has said at least a dozen times that the auditors who raised concerns about financial controls at RGC didn’t say anything about fraud or embezzlement. Therefore, Pickup gets off Scott-free. It would seem Jovanovich, a former CEO, would need to be spoon-fed a fraud report before taking action. CEOs should be familiar with the scope of an audit, as outlined in the engagement letter with the auditing firm. In most cases, the purpose of an audit is to prepare and present financial statements and opine on the effectiveness of internal controls (among other purposes agreed upon in the engagement letter). It would seem the audit firm did just that. It wasn’t in their scope and they didn’t have the resources to investigate fraud and embezzlement. Peter Jovanovich, a former CEO, has demonstrated he lacks the financial acumen to be mayor. Perhaps if he had spent less time harassing his CFO and more time on financials, he might have a clue about the word SCOPE.

    If you read the 2012 City of Rye audit you will see that all the matters concerning the Rye Golf Club were conveniently and intentionally left out of the audit.

    Every time Jowannasniffherpanties, Filipout and Stench get caught doing something wrong it seems they conspire to withhold information that is damaging to them and Stickup from the public.

    However, page 172 of the audit does say:

    We noted certain matters that we reported to the management of the City in a separate letter.

    What do Peter Jovanovich, Scott Pickup, Joe Sack and snow in August all have in common?

    If you allow me the political equivalent of poetic license, I will attempt to make the connection. Outgoing Councilman Peter Jovanovich, whose term ends this coming Dec. 31, has announced his intention to seek an independent line so that he can challenge Councilman Joe Sack, the Republican candidate for the post of Rye’s mayor, thereby seeking to extend the reign of outgoing Mayor Doug French, whose term also ends this Dec. 31, and the continuing city employment of Rye City Manager Scott Pickup.

    Now, I assume that most of us who follow Rye City politics know that: a) Jovanovich is a Doug French guy; b) Pickup is a French and Jovanovich guy; c) neither French nor Jovanovich had a prayer of becoming the Republican nominee for mayor; d) French, Jovanovich and Pickup have made it crystal clear they want Sack anyplace else in the world but on the Rye City Council, let alone on that council as the city’s mayor; and e) Sack has made no secret that he disapproves of French’s‑and Jovanovich’s‑governance of the city and that he is no fan of Pickup’s performance as city manager.

    Okay, so far Peter Jovanovich’s candidacy looks like an attempt to garner some payback for French, keep Scott Pickup running Rye post-January 2014 and to thwart Sack and his “Rye United” team‑which includes candidates for City Council Kirstin Bucci, Terry McCartney and Julie Killian‑come Election Day this November.

    But, you may rightfully ask: Where does the snow in August allusion come in?

    Before I explain my rhetorical device, let me, in the interests of full disclosure state that, while I enjoy cordial personal relationships with Doug French and Peter Jovanovich, politically I stand firmly in the Joe Sack camp. Further, I, along with the very same Joe Sack, am a candidate for district leader in Election District 9 in the Sept. 10 Republican Party primary. Finally, Joe’s other political supporters and effective running mates in this Sept. 10 esoteric exercise‑Rye Republicans, please mark your calendars and hang on to a copy of this column‑that I’m about to describe are: Andrew Dapolite and Diane Tolve in Election District 2; Daniela Vitiello in Election District 3; Grace Nemarow and Al Vitiello in Election District 4; Bob Cypher and Angela Sculti in Election District 8; and Jim Flick and Bill Soviero in Election District 13.

    Now, it seems that a small handful of Republicans actually support Doug, Peter and even Scott Pickup and believe that Peter, as “Doug Redux,” and Scott should continue to plot Rye’s future and run our city. This handful of disaffected GOPers was unable to stop the vast majority, myself included, of the Rye Republican City Committee‑the official body of the local Republican Party‑from nominating Joe and the rest of the “Rye United” team as its candidates in the November general election. They couldn’t even come up with alternative candidates to present to the committee, or to oppose its ticket in Republican primaries for mayor or city councilmembers. So, they have decided to attempt to take over the Rye Republican City Committee on Doug’s, Peter’s‑and, indirectly, on Scott’s‑behalf by running Republican primaries on Sept. 10 for the political posts of district leaders in six out of a total of 14 of our city’s geo-political subdivisions known as election districts.

    The district leaders‑officially known as Members of the Westchester Republican County Committee‑from their respective, election districts are the folks who compose the Rye Republican City Committee.

    All political parties are entitled to have their own respective local committees.

    Now, if you’re still with me, I will tell you where the snow in August comes from. In Rye, Republican primaries, particularly those for the political posts of district leader, are as rare as, you got it, snow in August.

    Okay, I admit that going from Republican primary to snow in August is a bit attenuated, but, in my defense, what kind of a title would “Peter, Scott and Joe and Republican primaries for district leader in six of Rye’s 14 election districts” have made?

    Peter Lane retired as the Rye City court judge and an acting Westchester County Family Court judge at the end of 2009 and is now, among other things, a political consultant.

  62. Jim, the topic is this November’s election for City Council where, from my point of view and I am not alone, the candidacy of Julie Killian is not in the best interests of Rye. The part of my comment you paraphrased pertains to the reason she was appointed (GOP donations) to the detriment of a well qualified candidate who got shot down (she didn’t make donations). The last sentence you paraphrased was another comparison of a person who feels the need put forth an impression of someone she is not, a poor comparison on my part. If you have any other points to make, put it in an email as we don’t need to come to closure about it on this blog.

    Secondly, the political landscape with Peter Jovanovich running for mayor is that of scorched earth. He created this environment and it will last until he’s beaten down in November. From now until then, it will be ugly. Every day voters should be reminded of the mess Chief Thief and his sexual predator deputy mayor have created.     20.The elements to be established in a negligence action are fivefold: duty, breach, actual cause, proximate cause, and damages.
    a.Duty.
    i.Defendant Jovanovich is the Deputy Mayor and a Councilman in Rye, New York.
    b.Breach.
    i.Holding those offices, it is established that Jovanovich owed a duty to the Plaintiff and others, but rather than upholding that duty Jovanovich exposed Plaintiff to a substantial risk of loss, thus breaching that duty. Where Jovanovich failed to realize the substantial risk of loss to Plaintiff, which any reasonable person in the same situation would clearly have realized, he also breaches that duty.
    ii.Where Jovanovich engaged in activities or failed to dis-engage others in activities that posed an unreasonable risk to others and their property that resulted in harm, thereby Jovanovich breached his duty of reasonable care.

  71. Andrew Dapolite Affair
    iii.On or about March 5, 2013, Scott D. Pickup, City Manager in Rye, New York (“Pickup”) portrayed to the city council, on camera, that “he (Pickup) didn’t have the ability to film a controversial Fire Department workshop meeting because he didn’t have the staff available,” or words to that effect.
    iv.Dapolite, one of the members of a two member department, was in the control room at City Hall on the night of February 9, 2013, and did record the meeting, contrary to the false claims of Pickup.
    v.Defendant Jovanovich has refused to listen to these tapes; Jovanovich has instead chastised Dapolite for making the recordings.
    vi.Where Jovanovich refuses to listen to the tapes, chastises Dapolite for making the recordings, in diametric opposition to the provisions in the Rye City Charter, failed in his responsibilities for making sure Pickup faithfully upholds, and follows, the law on residents’ behalves, Jovanovich negligently breaches his duty of reasonable care.

  72. …BREACH OF FIDUCIARY DUTIES
    Legal Standard

    21.A fiduciary duty is an obligation to act in the best interest of another party, in the case, the residents of Rye, New York.
    22.A fiduciary obligation exists whenever the relationship with a party involves a special trust, confidence, and reliance on the fiduciary to exercise his discretion or expertise in acting for the party.
    23.In being sworn into office in January 2010, Jovanovich knowingly accepted that trust and confidence to exercise his expertise and discretion to act on the residents of Rye, New York.
    24.When Jovanovich swore by oath to act for the residents of Rye, New York in a fiduciary relationship, the law forbids Jovanovich from acting in any manner adverse or contrary to the interests of the residents of Rye, New York. The residents of Rye, New York are entitled to the best efforts of the fiduciary on his behalf and the fiduciary must exercise all of the skill, care and diligence at his disposal when acting on behalf of the client.
    25.Where Jovanovich failed in his responsibilities to prevent the exploitation of deficiencies at Rye Golf Club, he breached his fiduciary duty to an approximate one third of the population of the residents of Rye, New York.

  73. …WHEREFORE, Plaintiff respectfully request entry of an Order directing as follows:
    a.Disqualifying the candidacy of Peter Jovanovich for the Mayor of the City of Rye;
    b.Directing Commissioner Reginald Lafayette and Commissioner Douglas Colety of the Westchester County Board of Elections to remove Respondent’s name from the ballot for the November 5, 2013 election;
    c.Permanently enjoining Peter Jovanovich from running for elected office in Rye while being an affiliate of The Rye Record;

    e.Granting such other and further relief as to the Court seems just and proper.

From the below analysis of the draft Complaint (lawsuit), and the Sack “Empty Chair Debate” video, it should be clear to the Rye City voters that Jovanovich and The Rye Record portray themselves, and have for many years portrayed themselves, as unrepentant, recidivist, incestuoans while Jovanovich holds public office and now seeks further public office which the Court must finally stop. The Southern District of New York will soon have the opportunity to speak.     vii.As Deputy Mayor and Councilman, Jovanovich is responsible for making sure that City Manager Pickup faithfully upholds, and follows, the law on residents’ behalves.
    viii.On June 14, 2010, auditors from the firm of O’Connor Davies Muns Dobbins presented a live report to the Rye City Council where, Jean Gribbins, the newly hired City Comptroller at the time, recommended that the auditors “take a deeper look” at the operations of one department in particular – Rye Golf Club; Jovanovich sat on the Audit Committee and, therefore, was already familiar with, and had a dialogue regarding, the meeting.
    ix.On September 12, 2012, in a meeting of the Rye Golf Club Commission, it was revealed that the general manager of Rye Golf Club, Scott Yandrasevich, had a financial relationship with a staffing company that has billed the club over $2.2 million dollars in the last 18 months alone, unchecked by Pickup.
    x.Manhattan law firm Brune & Richard LLP, determined that “Mr. Yandrasevich controlled a staffing company that, over a six-year period, was used to steal many hundreds of thousands of dollars from the City of Rye.”
    xi.Pickup, told club-goers that Yandrasevich had no conflict of interest, that everything was above board, and that the city attorney had previously vetted the situation herself and found nothing wrong; the claim was publically contradicted by the city attorney.
    xii.That same Brune & Richard report documented that Pickup, misled the public on Sept 27, 2012, when he – twice – said Rye’s corporation counsel had reviewed Mr. Yandrasevich’s relationship with the staffing company.
    xiii.Where Jovanovich failed in his responsibilities for making sure Pickup faithfully upholds, and follows, the law on residents’ behalves, Jovanovich negligently breaches his duty of reasonable care.
    c.Factual causation.
    i.It must be shown that the particular acts or omissions were the cause of the loss or damage sustained.
    ii.The causation between Jovanovich’s breach of duty and the harm that results to Rye Golf Club members increases the risk of harm, then the breaching party is liable in suit.
    iii.At the September 12, 2012 meeting at Rye Golf Club an alleged staffing company that has billed the club over $2.2 million dollars in the last 18 months alone, went unchecked by Pickup.
    iv.Where Jovanovich failed in his responsibilities for making sure Pickup faithfully upholds, and follows, the law on residents’ behalves, this instance provides the factual causation of the harm Jovanovich caused to occur.
    d.Legal causation.
    i.Jovanovich foresaw deficiencies at Rye Golf Club by the June 14, 2010, auditors’ report to the Rye City Council; Jovanovich sat on the Audit Committee.
    ii.Seeing deficiencies at Rye Golf Club, Jovanovich had a duty to take care to avoid it.
    iii.Where Jovanovich failed in his responsibilities to prevent the exploitation of deficiencies at Rye Golf Club, this instance provides the legal causation of the harm Jovanovich caused to occur.
    e.Damages.
    i.Damages place a monetary value on the harm done by Jovanovich.
    ii.For most purposes connected with the quantification of damages, the degree of culpability in the breach of the duty of care is irrelevant.
    iii.Once the breach of the duty is established, the only requirement is to compensate the victims of the Rye Golf Club affair.
    iv.Where Jovanovich failed in his responsibilities to prevent the exploitation of deficiencies at Rye Golf Club, this instance provides for the recovery of damages or equitable relief by Plaintiff; in this action, subject to any amended complaint as of right, Plaintiff prays for equitable relief.

    A former CTB/McGraw-Hill executive in Monterey who was fired from her $125,000 a year job was awarded $450,000 by a federal court jury for wrongful termination.
    The jury of three men and five women in federal district court in San Jose also ruled the former Macmillian/McGraw Hill School Publishing Co. acted in bad faith when Judith Ann Hill, 41, was fired on June 10, 1993, from her position as vice president of finance.
    In her lawsuit, Hill said that Peter Jovanovich, president and chief executive officer of what is now McGraw Hill School Publishing Co., owned by The McGraw-Hill Companies, flew to Monterey from corporate headquarters in New York to personally fire her after she complained of being sexually harassed by him.
    Jovanovich told Hill at one point that “he wanted her to be his moll,” said Novato attorney Nancy Krop, who represented Hill.
    When Hill protested, “basically” that was the end of her career” with the company, Krop said.
    Hill had also accused the company of sex discrimination and Jovanovich with sexual harassment in her lawsuit, but the jury ruled against her on those points, said company spokesman Steve Weiss.
    The $450,000 judgment against the company, which later in 1993 became The McGraw-Hill Companies, was the maximum award allowed, Krop said.
    “I think the company had to learn you treat people more humanely,” Krop said yesterday.
    Weiss said the jury award was likely the result of the company’s failure to give Hill written warning that her job was in jeopardy before firing her.
    Even so, “We do believe that we have a very valid basis for appealing the jury’s decision,” Weiss said. He added that the company hasn’t decided whether to appeal.
    Hill, the mother of two college-aged daughters, began her career as a $17,500 senior accountant and rose in 11 years to become the chief financial officer of the company’s CTB division in Monterey, earning $125,000 a year, Krop said.

    PSL is hellbent on getting Jov out of the race. Why? He has every right to run (regardless of the lawsuits/petitions he is filing. As a matter of fact, he is going to owe me an Espresso!). Without knowing a ton about what is going on currently, I see no way that Sack loses this race. I have a feeling that Rye politics are going to take on a whole new look come the new year. New PC, new city mgr — it is going to be interesting to see what other changes Joe makes.

  85. Andrew Dapolite Affair

    iii.On or about March 5, 2013, Scott D. Pickup, City Manager in Rye, New York (“Pickup”) portrayed to the city council, on camera, that “he (Pickup) didn’t have the ability to film a controversial Fire Department workshop meeting because he didn’t have the staff available,” or words to that effect.

    iv.Dapolite, one of the members of a two member department, was in the control room at City Hall on the night of February 9, 2013, and did record the meeting, contrary to the false claims of Pickup.

    v.Defendant Jovanovich has refused to listen to these tapes; Jovanovich has instead chastised Dapolite for making the recordings.

    vi.Where Jovanovich refuses to listen to the tapes, chastises Dapolite for making the recordings, in diametric opposition to the provisions in the Rye City Charter, failed in his responsibilities for making sure Pickup faithfully upholds, and follows, the law on residents’ behalves, Jovanovich negligently breaches his duty of reasonable care.

  87. Rye Golf Club Affair
    i.As Deputy Mayor and Councilman, Jovanovich is responsible for making sure that City Manager Pickup faithfully upholds, and follows, the law on residents’ behalves.
    ii.On June 14, 2010, auditors from the firm of O’Connor Davies Muns Dobbins presented a live report to the Rye City Council where, Jean Gribbins, the newly hired City Comptroller at the time, recommended that the auditors “take a deeper look” at the operations of one department in particular – Rye Golf Club; Jovanovich sat on the Audit Committee and, therefore, was already familiar with, and had a dialogue regarding, the meeting.
    iii.On September 12, 2012, in a meeting of the Rye Golf Club Commission, it was revealed that the general manager of Rye Golf Club, Scott Yandrasevich, had a financial relationship with a staffing company that has billed the club over $2.2 million dollars in the last 18 months alone, unchecked by Pickup.
    iv.Manhattan law firm Brune & Richard LLP, determined that “Mr. Yandrasevich controlled a staffing company that, over a six-year period, was used to steal many hundreds of thousands of dollars from the City of Rye.”
    v.Pickup, told club-goers that Yandrasevich had no conflict of interest, that everything was above board, and that the city attorney had previously vetted the situation herself and found nothing wrong; the claim was publically contradicted by the city attorney.
    vi.That same Brune & Richard report documented that Pickup, misled the public on Sept 27, 2012, when he – twice – said Rye’s corporation counsel had reviewed Mr. Yandrasevich’s relationship with the staffing company.
    vii.Where Jovanovich failed in his responsibilities for making sure Pickup faithfully upholds, and follows, the law on residents’ behalves, Jovanovich negligently breaches his duty of reasonable care.
