Judge Reverses $650K Decision Against Rye Cop

A judge has reversed a $650K award made to a couple that had sued a Rye cop and Rye city just this past fall:.

"A state Supreme Court judge shot down an arbitrator's decision to award $650,000 to a Dutchess County couple who were injured in a car accident with a Rye police officer more than three years ago.

According to the original lawsuit, Detective Joseph Verille was traveling north in an unmarked police vehicle on Interstate 684 near Exit 8 in North Salem when he rear-ended Louis Jeanette’s car on April 19, 2012…

The arbitrator, former state Supreme Court Justice Louis Barone, sided with Jeanette. In his Aug. 1 decision to award $650,000, Barone said he suffered several back injuries, a concussion and anxiety and remains limited in his ability to work.

The City of Rye appealed and won. State Supreme Court Justice Mary Smith said in her Dec. 3 decision Barone made his ruling without hearing arguments from the defendants…

Tirone [attorney for the couple] has appealed Smith’s decision to vacate the arbitrator's ruling."
