141 Neighbors of The Osborn Home Ask City Council to Delay Zoning Vote

One hundred and forty one neighbors of The Osborn retirement community have asked the Rye City Council not to vote on The Osborn petition to to amend the City of Rye Zoning Code on Wednesday during the scheduled City Council meeting. Instead, neighbors are asking for the public hearing to remain open until October. The current meeting agenda shows a scheduled vote.

The request to wait until the fall was made in a letter from the 141 residents to the Mayor and Council on Monday. “The public is just now (June 10, 2022) able to see in writing the newest zoning proposal ahead of the planned June 15, 2022 Public Hearing,” says the letter. “What many members of the public heard, versus those changes shown in the revisited proposal, the comparative zoning chart and the revised Illustrative Site Plan differ considerably. We appreciate The Osborn preparing and sharing this updated information, but we the public respectfully request the necessary time to understand and absorb the latest set of information.”

Special Super Majority Needed

If and when the Council does vote on the The Osborn petition to to amend the City of Rye Zoning Code, it will require a super majority of the City Council versus a simple majority – a special condition triggered by General City Law 83. This means the zoning change will require six of the seven Council votes in order to pass. Last Wednesday, Rye City Clerk Carolyn D’Andrea confirmed this condition was triggered after more than 20% of adjacent landowners file a protest petition against the zoning code change. In fact 21 landowners, representing 45.54% of adjacent land, filed and objection and protest on May 23rd.

The Council meeting – now scheduled for Zoom (not in person) – should be interesting …

  1. While I respect and understand the concerns raised by neighbors of the Osborn, I would ask that the neighbors also consider the interests of Rye’s seniors who are or will be experiencing a pressing need for the kind of housing and services that the Osborn provides. My ability to stay in Rye where I have lived for the past 45 years is directly related to the Osborne’s ability to provide a continuum of housing from independent living to continuing care. If the Osborn is not permitted to expand its facilities and address the growing needs of the senior community, my husband and I and the many seniors in Rye like us will have no choice but to move elsewhere. I urge the Rye City Council and the Osborn neighbors to consider the needs of the broader community and the vital services that the Osborn provides to Rye’s seniors.

As a neighbor who has been very involved in the zoning discussion, I would like to respond to Pam’s very valid comment to say that the vast majority of The Osborn’s neighbors fully understand and acknowledge The Osborn’s need and desire to grow. We all want Rye residents (and new to Rye residents) to be able to stay in Rye as they age, and we want The Osborn to succeed so they can provide this important service. Neighbors who have been involved in this discussion very much want to see The Osborn succeed, and we understand a zoning change to be part of the path to their success. We would like to work together with The Osborn collaboratively to find a zoning amendment solution that gives The Osborn the flexibility it needs to succeed, while also protecting the character of our residential neighborhood. We are certain that with the proper time to come together and collaborate that we can find a solution that is good for all involved parties. We are only asking for the time to allow these conversations to happen.
